Wow! It is so hard to understand the greed of people! My condolences on the passing of your father. I am sorry that you had and are having to go through this. Hopefully, you can get the neighbor to fix the road issue. It isn't theirs and generally, most law officials would agree. We already solved the issues of expanding onto the property along the edges. Regarding the road issue, in the end, we decided to take a different approach - a diplomatic and/or reciprocally compensating one. In other words, leaving the road as it currently is, we are allowing one of our neighbors an additional access way to their property through our estate while, at the same time, we are also getting an additional access way to our property through their estate. Still, we were stunned that they did it just like that without asking anyone anything.
However, they all know now that they can't do things like that just like that. They are a bit ashamed and somewhat thankful that we didn't make a big drama out of that all, although we clearly stated our minds.
All in all, things are slowly getting better and better, and we decided to move on. After all, if we choose to use the part of the land where the road is now differently at any point in time, we can place the fence there and close it.
From the legal perspective, we have all the rights to do something like that or even to ask for the road to be removed and this portion of the land restored to its original state. But, as I said, we are not planning to do something like that. Instead, we took it as a new option and opportunity rather than an obstacle and issue.
