What I think

A 'black mark', this is serious. Because they were part of bad company culture, like if they had a choice or they had any hand in creating that culture. And yes I know every person has the power to change their environment and probably a group of executives would have been able to steer it in a different direction. But it didn't happen and no employee is to blame.

It was not their company and it was not their job, so being judged by that, and diminishing their chances of getting a job is simply NOT RIGHT!

Not hiring them based on that, I think says more about the hiring person than their experience says about the employees. Their choice was to work on the most exciting startup right now and they thought they had to go along with their culture. The choice of the hiring manager is either to hire a human due to where they came from and not what they can do.

Not to mention that if any of those employees would have decided to change jobs a few months prior it would have been regarded as a great hire. So yes the company fell from grace with the news outlet, but leave the non-responsible employees out of it.
